The Bluesky Way Coaching Services Agreement

PLEASE READ THESE TERMS CAREFULLY BEFORE USING MY SERVICES

1. Acceptance of Terms

By purchasing and using coaching services rendered by Katie Landmark at The Bluesky Way (the "Company"), you signify your consent to these Terms and Conditions. If you do not agree to these Terms, please do not use my services.

2. Description of Services

Coaching provided by The Bluesky Way includes individual (1:1) coaching sessions. These coaching sessions are designed to support you in maximizing your personal and professional potential.

I am committed to providing thoughtful, strategic, high-integrity coaching support. If, after completing our agreed-upon coaching engagement and actively implementing the strategies discussed, you feel we have not made meaningful progress, please reach out within 14 days of our final session. At my sole discretion, I may offer a complimentary follow-up session to review, recalibrate, and identify next steps.

3. Responsibilities

  • Coach’s Responsibilities: I will adhere to the International Coach Federation (ICF) Code of Ethics and standards of behavior. I will provide guidance, support, and tools but cannot be liable for your actions, decisions, or results.

  • Client’s Responsibilities: You are responsible for your own physical, mental, and emotional well-being, decisions, choices, actions, and follow-through to create results. Coaching is not a substitute for professional advice from legal, mental, medical, or other qualified professionals.

4. Services

  • Individual Coaching: I will provide high-impact, high-integrity private coaching sessions via the agreed mode of communication (e.g., phone or virtual via Google Meet or Zoom).

5. Schedule & Fees

  • Effective Date: This agreement becomes effective upon purchase of coaching services.

  • Fees: Fees are payable before each session or program, as applicable. Payment will be processed through the agreed payment method before services are rendered.

    • Note: Power Session packages expire 12 months after purchase.

  • Subscription Fees: Monthly Momentum Accelerator memberships renew monthly unless canceled prior to the next billing cycle. Cancellation will take effect at the end of the current paid period.

6. Procedure

I will contact you for sessions via the agreed mode of communication. You must notify me of any changes to your contact details prior to the scheduled appointment.

7. Confidentiality

The coaching relationship and all information shared are bound by the ICF Code of Ethics but are not legally confidential. I agree not to disclose any information without your written consent. Confidential information does not include information that:

(a) Was already in my possession before being provided by you;
(b) Is generally known to the public or your industry;
(c) Is obtained from a third party without breach of any obligation to you;
(d) Is independently developed by me without reference to your confidential information;
(e) Is required to be disclosed by law.

Topics may be shared anonymously and hypothetically with other coaching professionals for training, supervision, mentoring, and development purposes.

8. Cancellation and Rescheduling Policy

  • You must notify me at least 48 hours in advance if you need to cancel or reschedule a scheduled session.

  • If you neglect to notify that you cannot make a session, I will wait for 15 minutes after the scheduled time before marking you as a no-show. And thus, if you are unable to attend in that session, the session will be billed as if it occurred.

9. Termination

Either party may terminate this agreement at any time. Upon termination, you will be billed for any sessions rendered up until the termination date.

10. Refunds and Cancellations

All fees are non-refundable. You may cancel at any time, but will not receive a refund for any previously paid sessions or programs.

11. Limited Liability

Except as expressly provided in this agreement, I make no guarantees or warranties, express or implied. I am not liable for any consequential or special damages. My liability is limited to the amount paid by you for services rendered up until the termination date.

12. Intellectual Property

All content provided by The Bluesky Way, including videos, training materials, and other resources, are the property of the Company and/or its third-party providers. You may not copy, reproduce, republish, upload, post, transmit, distribute, or use any content for public or commercial purposes without my express written permission.

13. Data Security

While I use reasonable efforts to protect the confidentiality of your data, no system can be entirely secure. Use of my services is at your own risk.

14. Privacy Policy

I will not intentionally disclose any personally identifying information about you to third parties, except as necessary to comply with the law or enforce these Terms. By using my services, you accept the Company’s Privacy Policy.

15. Disclaimer of Warranties

The services provided are offered on an ‘as is’ basis, with no guarantees or warranties, express or implied. While I’m committed to delivering high-value support, I cannot promise specific outcomes as results depend on your actions and implementation.

16. Indemnification

You agree to indemnify and hold harmless The Bluesky Way and its affiliates from any claims, damages, or expenses arising from your breach of this agreement, violation of law, or use of the services.

17. Changes to Terms

These Terms may be revised from time to time. You are bound by any such revisions and should periodically review these Terms.
