Terms and Conditions of The Bluesky Way

Please read these Terms and Conditions ("Terms") carefully before using The Bluesky Way website ("theblueskyway.com") and its associated services. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not access or use the Website.

1. Services Offered

The Bluesky Way currently offers the following services:

• Complimentary Strategic Consult: A no-obligation conversation designed to explore your goals, identify areas of friction, and determine whether coaching is the right fit.

• Power Sessions: Focused 1:1 coaching sessions designed to provide strategic clarity, perspective, and momentum around a specific challenge, decision, opportunity, or transition.

• Monthly Momentum Accelerator: An ongoing coaching partnership that provides weekly strategic support, accountability, and recalibration designed to help clients operate with greater clarity, sustainability, and momentum.

• Additional workshops, resources, and offerings may be introduced periodically and will be governed by these Terms and any supplemental agreements provided at the time of purchase.

2. Payment Terms

• Payment: Payment for all services must be made in full prior to, or at the start of, any coaching session or program unless otherwise agreed upon. Accepted payment methods will be communicated during the booking process.

• Currency: All payments are processed in USD currency.

3. Cancellation, Rescheduling, and Refund Policy

• Free Strategic Consult (15-minutes): No cancellation fees apply for this free call. However, please notify me in advance if you are unable to attend.

• All Sessions (Power Sessions or Monthly Momentum Accelerator): If you need to cancel or reschedule, please notify me at least 48 hours before your scheduled session; there is no rescheduling fee, however, no-shows will result in a billed session. Services are non-refundable. The terms, duration, and payment schedule for these packages will be outlined and agreed upon during a consultation. If cancellation is required, please notify me in writing.

4. Guarantee of Support

I am fully committed to helping you achieve your goals and make lasting transformations through my coaching programs. While I cannot guarantee specific outcomes, I am committed to providing consistent, personalized support and working with you to master the necessary strategies and inputs required to reach your desired results. This commitment is central to every program I offer, but it’s important to note that results depend on your engagement, effort, and willingness to apply the strategies discussed.

5. Intellectual Property Rights

All content, materials, and resources provided by The Bluesky Way, including but not limited to text, graphics, logos, images, videos, templates, and workbooks, are protected by copyright and intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content provided by The Bluesky Way without prior written consent.

6. Confidentiality and Privacy

• Confidentiality: I respect the confidentiality of all personal and sensitive information shared during coaching sessions. I will not disclose any personal information without your consent, except as required by law.

• Privacy: Your personal information is collected solely for the purpose of providing you with requested services and will never be sold, rented, or shared with third parties unless required by law. 7. Limitation of Liability

• No Guarantees of Results: While I am dedicated to helping you achieve your goals and get results, I cannot guarantee specific outcomes or results. The effectiveness of my services depends on your engagement, effort, and willingness to apply the strategies discussed.

• Limitation of Liability: The Bluesky Way and I, as the coach, shall not be held liable for any direct, indirect, incidental, special, or consequential damages that may arise from the use of my services or the Website. By using my services, you acknowledge and agree that I am not responsible for the outcomes of coaching or any personal decisions you make.

• Coaching Disclaimer: Coaching is not therapy, medical treatment, financial advice, legal advice, or consulting services. Coaching is designed to support personal and professional development through strategic conversation, reflection, accountability, and self-leadership. Clients remain fully responsible for their decisions, actions, and results.

8. Termination of Services

I reserve the right to terminate or suspend services if, in my sole discretion, you violate these Terms, or engage in unlawful or inappropriate behavior that impacts the coaching process or the Website’s functionality.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state or country in which The Bluesky Way operates, without regard to its conflict of law principles. Any disputes shall be resolved within the jurisdiction of that location.
